

The chart below lists the forms, designated classifications within each form type, and current availability and termination dates (when applicable) for premium processing service. If the petition requires the submission of additional evidence or a response to a notice of intent to deny, the 15 or 45-day premium processing time period will stop, and a new time period will begin when we receive a complete response to the request for evidence or notice of intent to deny. We will issue an approval notice, denial notice, notice of intent to deny, or request for evidence, or will open an investigation for fraud or misrepresentation within the associated time period. A properly received petition must be complete with a proper signature and accompanied by the correct fee. The associated time period will begin when we properly receive the Form I-907, Request for Premium Processing Service, at the correct filing address noted on the form. As new categories become available, please refer to the chart below for corresponding processing times. Specifically, we guarantee that we will take some adjudicative action on the case within 15 calendar days for most classifications or 45 calendar days for Form I-140 E13 multinational executive and manager and Form I-140 E21 national interest waiver classifications, or we will refund the premium processing fee and will continue with expedited processing.

Premium processing provides expedited processing for Form I-129, Petition for Nonimmigrant Worker, and Form I-140, Immigrant Petition for Alien Worker, for a fee.
I140 PROCESSING TIME UPGRADE
Please see the Form I-140 information below for information on the upgrade schedule. The premium processing fee will be $2,500, and the processing time will be 45 days instead of the typical 15 days available for other eligible categories.ALERT: USCIS has started to expand premium processing services to include certain previously filed Form I-140 petitions requesting E13 classification for multinational executives and managers and E21 national interest waiver (NIW) classification. USCIS has not yet extended premium processing for initially filed Form I-140 petitions in the EB-1C and EB-2 categories. While this change is favorable, the improvement is marginal. From July 1, 2022, USCIS will accept premium processing upgrade requests for EB-1C multinational executive and manager petitions received on or before March 1, 2021, and EB-2 NIW petitions received on or before June 1, 2021.From June 1, 2022, USCIS will accept premium processing upgrade requests for EB-1C multinational executive ad manager petitions received on or before January 1, 2021.The agency’s expansion will apply in the following phases: USCIS hopes that this change will help alleviate the lengthy processing delays in these immigrant visa categories. The agency will now allow applicants who previously filed under EB-1C multinational executive and manager and EB-2 National Interest Waiver (NIW) categories to premium process their petitions.
